General Terms and Conditions 

1. GENERAL

1.1 These terms and conditions ('Terms') explain your rights and obligations in relation to this web site located at www.caldergates.co.uk ('Site') and any goods purchased through this Site. Please read them carefully. If there is anything you do not understand then please contact us. 

1.2 This Site is operated by Calder Gates Limited ('we', 'our' or 'us').

1.3 We may change the Terms at any time by posting such changes on the Site. Your continued use of the Site after notice of changes shall mean you are bound by the new terms. 

2. USE OF THE SITE

2.1 The content of and copyright in the Site is owned by or licensed to us. You are permitted to view or print individual pages for your own personal use only. Any other use or copying text, pictures or any other content on this site must be with our prior written permission. 


2.2 We reserve the right to suspend, restrict or terminate your use of this Site at any time. 

3. PRIVACY POLICY

3.1 We collect only the necessary information required to process your order & payment. These details will NOT be passed to any third party & no record of your credit card details are stored by us. We use Sagepay, a completely secure payment system for your transaction. We will not pass on any information given to us by you to any third parties apart from the courier for your item which will be given your name, delivery address and a contact telephone number only some courier may also require your email address. 

4. PRICING

4.1 All prices are in British Pounds. We reserve the right to change the prices of any of our items and delivery charges without prior notice. This is mainly due to the fluctuating prices of raw materials and transport costs. 

5. DELIVERY

5.1 All of our goods are delivered by couriers. Which for gates and railings we will contact you to arrange a specific date for your goods to be delivered. If we are unable to contact you to arrange a delivery date and you are not able to accept the goods you will incur any additional re-delivery charges should there be any.  We will not be held responsible for any delays in delivery caused by the couriers.

5.2 We aim to deliver all of our items within 28 days* (Mainly for gates and railings) of order confirmation, however in the rare case that your goods have not been despatched within 28 days* of order confirmation you will be given the option of a full refund. Any delivery times given are estimates only.
*Please allow up to 38 days for delivery of galvanised goods. 

5.3 Please check all items for damage incurred during the couriers transit prior to signing for the item, as we are not held responsible for damage incurred during transit.

5.4 We will not ship any items outside of the U.K mainland. We will not ship to Ireland, Northern Ireland, the Scottish Highlands and Islands. 

5.5 We do everything we can to ensure delivery times and dates given, however occasionally delivery times may be affected by factors beyond our control and therefore cannot be guaranteed. We therefore recommend that a fitter is not booked until you are satisfied your order has been delivered and received correctly.

6. RETURNS

6.1 We will only accept returns of faulty items and items that differ from the advertised goods and are not responsible for any damage during transit or unloading of the item. We will not accept returns for items which have rusted as this is a natural occurrence in mild steel which is not treated. To prevent rust apply sufficient paint as required. Galvanised steel will have a hole no bigger than 9mm at the bottom and top of any hollow steel. Galvanised steel may also have a rougher finish than plain painted steel due to the dipping process, this is out of our control and is will not be classed as a fault. Please be 
aware that most of our items are handmade and may differ slightly from the ones shown 
and described. 

6.2 We will, or you can arrange a delivery option for you to return the item at your costs and we will decide whether the item will be repaired, replaced or refunded. The item will then be delivered back to you at our costs and your costs of returning the item refunded if we decide the item to be faulty. 

6.3 We will not accept returns or refunds if an item is ordered in the wrong size, style, finish or colour by you, nor will we accept returns for any items which have been damaged due to incorrect fitting. 


6.4 If you have faulty items please contact our office immediately via email or telephone advising the nature of the problem, date of purchase and name of purchaser and we will do our best to sort the problem out quickly. Please retain any original packaging. 


7. PURCHASING FROM US

7.1 To purchase from us you must be resident in the United Kingdom mainland, excluding Ireland, the Scottish Highlands, and Channel Islands .We cannot ship to locations outside the United Kingdom mainland. 

7.2 The Site and the goods sold through it are subject to change without notice and we reserve the right to improve, alter or modify designs without prior notification. We will inform you of any changes to the advertised goods prior to despatch of such goods. If you are unhappy with these improved, altered or modified goods you may inform us in writing (including fax or email) within 7 days, starting on the day after the goods are delivered to you. In order to receive a refund, the goods must be returned to us unused, and wherever possible in the original packaging, together with your receipt. We recommend that you retain all of the original packaging until you are sure that you intend to keep the goods. If the original packaging is not available, you should use packaging that would provide similar protection as returned items must be received ‘as new’ and in re-saleable condition. (Please note: Carriage costs will be refunded only if the item is faulty, or if it differs in any way from the advertised goods). Returned parcels remain the responsibility of the customer until safely received by us. The company does not pay return carriage unless an item is faulty, or it differs in any way from the advertised goods. If you would like us to arrange collection of goods for return, please contact by email or telephone. Return carriage costs will be deducted from any refund due. 

7.3 If the ordered goods are not available within 28 days of order confirmation we will advise you of this as soon as reasonably possible. You will be given the option of ordering an alternative product or receiving a full refund. 

7.4 By submitting your order you are offering to buy the goods and allowing us to use your personal details for the purposes of supplying goods (including passing your details on to couriers and other subcontractors). 

7.5 We are not obliged to supply the goods to you until we have confirmed that we have accepted your order and received payment in full. 

7.6 All drawings, specifications, sizes, photographs, descriptive matter and advertising published by us or contained on our Site are only for giving an approximate idea of the goods described in them and colours shown are intended as a guide only.

 

8. CANCELLATION POLICY

8.1 As most of the items for sale on this website are made to order we currently do not offer a cancellation policy.

9. ITEM DESCRIPTION

9.1 All drawings and photographs are for illustration purposes only, as most of our products are made to order to varying sizes they may vary slightly from those shown in photographs and drawings. 

9.2 The heights of arched top gates may vary slightly from those listed in the item description. A arches are rolled individually to suit the gate width which means the gate heights may not be exact.

9.2 All fixing bolts and eyebolts are supplied unpainted (bare finish)
